01 Acceptance of Terms

If you do not agree with any part of these Terms, you must discontinue use of our services immediately. We recommend that you print or save a copy of these Terms for your records. Your continued engagement with Samart Watches after any modifications to these Terms constitutes your acceptance of the revised Terms.
These Terms are supplementary to and should be read in conjunction with our Privacy Policy, which governs the collection, use, and protection of your personal information.

We operate from our physical location at R City Mall, Ghatkopar West, Mumbai, and through our website samartwatches.shop. We offer a curated selection of smartwatches from 50+ brands ranging from budget-friendly options to premium luxury models.
Our business includes the sale of genuine smartwatches with manufacturer warranty, after-sale support services including setup assistance, strap replacements, screen protector installation, and warranty claim facilitation. We are committed to providing an authentic, transparent, and customer-centric shopping experience.
03 Products and Pricing
3.1 Product Authenticity
All smartwatches and accessories sold at Samart Watches are 100% genuine and sourced from authorized distributors, manufacturers, or their authorized channels in India. We do not sell counterfeit, refurbished (unless explicitly stated), grey-market, or unauthorized products. Every product comes with a valid manufacturer warranty and original packaging.
3.2 Product Availability
Product availability is subject to stock at our physical store. While we strive to keep our inventory updated, certain models may be temporarily out of stock due to high demand or supply chain constraints. We reserve the right to limit quantities per customer for popular or limited-edition products. 3.3 Pricing
- All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless explicitly stated otherwise.
- Prices are subject to change without prior notice. However, the price applicable to your purchase will be the price confirmed at the time of billing.
- Any promotional discounts, seasonal offers, or bundle deals are available for a limited period and may be withdrawn at our discretion without prior notice.
- We reserve the right to correct any pricing errors. In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel the order with a full refund.
- Price matching requests are considered on a case-by-case basis and are subject to verification of the competitor's offer.
3.4 Product Information

04 Orders and Purchases
4.1 In-Store Purchases
When you purchase a smartwatch at our physical store, the transaction is completed at the point of sale. A valid purchase invoice will be provided to you at the time of billing. This invoice serves as your proof of purchase and is required for all warranty claims, returns, or exchanges. We strongly recommend keeping your invoice in a safe place.
4.2 Online Enquiries
Enquiries submitted through our website contact form are not orders but requests for information. Our team will review your enquiry and respond with product availability, pricing, and any other requested details. A purchase is considered confirmed only after full payment is received and an invoice is generated.
4.3 Order Confirmation
For confirmed purchases, we will provide you with a detailed invoice containing the product name, model number, serial number (if applicable), price, payment method, date of purchase, and warranty details. Please verify all details on the invoice at the time of purchase. Discrepancies should be reported immediately.
05 Payment Terms
- We accept payments in cash, via UPI (Google Pay, PhonePe, Paytm, BHIM UPI), debit cards, credit cards, and net banking.
- EMI options may be available on select credit cards and through partner financing companies for purchases above Rs. 3,000. EMI availability, tenure, and interest rates are subject to the policies of the respective bank or financing partner.
- All payments must be completed in full before the product is handed over to the customer, unless prior credit arrangements have been approved in writing.
- We do not accept foreign currency. All transactions are processed in Indian Rupees (INR).

06 Warranty and Guarantees
6.1 Manufacturer Warranty
All smartwatches sold at Samart Watches come with a manufacturer warranty. Typical warranty periods are:
- Indian Brands (Noise, Fire-Boltt, Boat, Amazfit, Realme, etc.): 1 year manufacturer warranty from the date of purchase.
- Premium Brands (Apple, Samsung, Garmin, Huawei): 1-2 years manufacturer warranty, depending on the specific model.
- Accessories (straps, chargers, screen protectors): Varies by product — typically 3-6 months for accessories.
6.2 Warranty Coverage
Manufacturer warranty typically covers manufacturing defects and hardware malfunctions under normal use. Warranty does NOT cover:
- Physical damage caused by drops, impacts, crushing, or excessive force.
- Water damage beyond the stated water resistance rating of the product.
- Damage caused by unauthorized repairs, modifications, or opening of the device.
- Damage caused by use of non-original or incompatible accessories.
- Normal wear and tear of straps, screens, and exterior surfaces.
- Software issues that can be resolved through updates or resets.
- Battery degradation that falls within normal parameters.
6.3 Warranty Claims Process
To initiate a warranty claim, you must present the original purchase invoice from Samart Watches at our store. Our team will assess the issue and, if covered under warranty, facilitate the repair or replacement process through the manufacturer's authorized service center. Processing times vary by brand and typically range from 7 to 30 business days.
07 Returns and Refunds
7.1 Return Policy
Returns are accepted under the following conditions:
- Manufacturing Defect: If the product has a manufacturing defect discovered within 7 days of purchase, we will facilitate a replacement or refund as per the manufacturer's policy.
- Wrong Product Delivered: In the rare event that you receive a different product than what was billed, we will immediately replace it with the correct product at no additional cost.
- Dead on Arrival (DOA): If the product is non-functional out of the box, we will arrange a replacement after verification by our technical team.
7.2 Non-Returnable Items
- Products with physical damage caused by the customer after purchase.
- Products without the original purchase invoice.
- Products with tampered serial numbers, removed warranty stickers, or signs of unauthorized repair.
- Accessories that have been opened, used, or fitted (straps, screen protectors, etc.).
- Products returned after the stipulated return window period.
7.3 Refund Process
Approved refunds will be processed using the same payment method as the original purchase. UPI refunds typically take 3-5 business days, credit/debit card refunds may take 7-10 business days, and cash refunds are processed at our store within 24 hours of approval.
08 Notification and Communication Consent
By accepting this policy, you acknowledge and consent to receive notifications and promotional communications from us through various channels, including but not limited to email, mobile push notifications, SMS, RCS (Rich Communication Services), WhatsApp, or any other digital communication platforms.
When you interact with Samart Watches — whether by submitting an enquiry form on our website, making a purchase at our store, signing up for our newsletter, or providing your contact information in any manner — you may be presented with a consent checkbox. - Your consent covers communications sent by Samart Watches directly and through our authorized communication partners, including My Inbox Media, who may assist us in delivering these messages on our behalf in compliance with applicable regulations.
- The content of promotional communications will be relevant to our products and services. We will not send unsolicited messages about unrelated third-party products or services.
- We will make reasonable efforts to manage the frequency of communications to avoid inconvenience, but the exact frequency may vary based on ongoing promotions, new arrivals, and seasonal campaigns.
8.1 Opting Out of Communications

Upon receiving your opt-out request, we will take the following actions:
- Process your request within a reasonable timeframe, typically 7-10 business days from the date of receipt.

- You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any materials from our website without prior written consent from Samart Watches.
- Brand names, logos, and trademarks of smartwatch manufacturers (Apple, Samsung, Noise, etc.) displayed on our website and in our store are the property of their respective owners and are used for identification purposes only.
- Product images used on our website are for illustrative purposes. Actual products may vary slightly in appearance.
10 Customer Conduct
When visiting our physical store or interacting with us through any channel, you agree to:
- Conduct yourself in a respectful and courteous manner towards our staff, other customers, and store property.
- Not engage in any fraudulent, deceptive, or illegal activities, including attempting to use counterfeit currency, stolen payment instruments, or false identification.
- Not damage, tamper with, or mishandle display products, store fixtures, or any property belonging to Samart Watches or R City Mall.
- Comply with all rules and regulations of R City Mall, including parking rules, security protocols, and code of conduct.
- Provide accurate and truthful information when submitting enquiry forms, making purchases, or requesting services.
We reserve the right to refuse service, ask individuals to leave our store, or ban individuals from future visits in cases of misconduct, fraudulent behavior, or violation of these terms.
11 Limitation of Liability
To the maximum extent permitted by applicable law:
- Samart Watches shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including loss of profits, data, goodwill, or other intangible losses.
- Our total liability for any claim shall not exceed the amount you actually paid to Samart Watches for the specific product or service giving rise to the claim.
- We are not liable for delays, failures, or interruptions caused by factors beyond our reasonable control, including manufacturer supply chain issues, courier delays, banking system failures, or government regulations.
- We are not responsible for the performance, functionality, or compatibility of third-party applications, software, or services used in conjunction with the smartwatches we sell.
12 Indemnification
You agree to indemnify, defend, and hold harmless Samart Watches, its owners, employees, agents, partners, and affiliates from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your breach of any provision of these Terms and Conditions.
- Your violation of any applicable law, regulation, or third-party right.
- Any misrepresentation made by you regarding your identity, contact information, or purchase intent.
- Any unauthorized use of products purchased from us.
- Any damage caused by you to our store property, display products, or to third parties during your visit.
13 Force Majeure
Samart Watches shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, government actions, wars, terrorism, riots, civil unrest, fire, flood, earthquake, power failures, internet outages, supply chain disruptions, labor strikes, or transportation disruptions. 14 Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
